Brother drove my car got into accident. Other party got attorney

So I have 2 cars under my insurance. My brother used one of those cars to go get food. I wasn’t home so I didnt know about this. He wes in the drive thru line and rolled into a car at no less than 10ft from him. He gave my insurance card and there was no damage fron what the pictures show. The guy said he wouldn’t place a claim.

Fast forward following day he placed a claim, for injury and not car damage. Apparently my car insurance may have given him a card time and they informed me he got an attorney.

My brother doesn’t have insurance because he doesn’t drive he has a suspended license.

I dont know what to do. I dont want to get my brother in trouble but i also need advice.
