I was rear ended a few weeks ago. The Vehicle that hit me was a rental and rental company (Enterprise) claims department accepted the responsibility 100%.

    The repair cost of my vehicle is $10600. A rental is additional.

    The problem is the insurance policy that Enterprise has Property Damage (PD) limit of 10K. So $600 of repair cost is additional to the 10K they are paying that I will pay out of my own pocket.

    My question is that is there a way to go after the driver and claim the remaining cost?

    Additionally, the driver might have a secondary policy with Greco. Initially, Greco said Enterprise should pay. Can I claim with Gieco for the remaining cost?

    1. Yes, you can do this but there may be coverage issues…and communication issues between the two companies.

      If I were in this position, I would consider using my own policy coverage and letting them collect from both companies. Save the headache…just my 2 cents.

      Also depends on the state for which coverage with the rental car is primary (some states the rental company is primary – could be why they only have 10k in limits). Could be an an agreement with the renters employer also (say they work for XYZ company, and XYZ has an agreement with Enterprise to cover the first 10k).

    2. File with Geico. No harm in trying. Otherwise there is always small claims, but even if you win no guarantee you’ll actually receive any money from a judgement.
