My sister recently got into a car accident where she rear-ended someone who slammed on their brakes in front of her. The girl did not have a driver’s license, was ticketed for it, and it turns out the car isn’t registered under her name nor is the insurance company. Assuming she was driving someone else’s car and illegally, is my sister still liable for the damages on the other person’s car?

    1. Yes, she is liable for damages to the owner’s car regardless of the circumstances leading up to the damage.

    2. Depends on the state.
      In Louisiana, if you don’t have liability coverage, you can’t claim under someone else’s liability.
      There are some other caveats…

    3. In 90% or more of the states she’s taking the hit. Ethically speaking she has it coming. You can’t do that and skate.

      Of course she is. She damaged someone else’s property, and was at fault. Nothing else beyond that matters.
