What happens when the registered owner of the car has an auto policy but for a different car. Can I file a claim to the owner of the car even if the policy is for a different car and he did not include the car that hit me?

My car was totalled by uninsured and at fault driver during discovery they said….The driver using the car is uninsured the registered owner of the car has an insurance but for a different car

You’d need to sue the owner directly. Since the car isn’t on the owners policy the insurance company would simply deny the claim.

    2. No. Insurance follows the vehicle in most areas. You would have to use yours or sue them in court for the damages.

    3. Assuming you have uninsured motorist coverage, and I’m really hoping you do, all you are going to do is call your carrier and file a claim like normal. They’ll pay you out and then handle all the lawsuits downstream of that afterwards to get paid back. You won’t have to be involved. There’s a deductible for you to pay more than likely but you’ll get that refunded to you once your company recovers their damages.

If you don’t have UM coverage call a lawyer because it’s going to be a complete mess and you’ll need professional help to manage the litany of legal issues. You’ll probably still end up filing a claim but I wouldn’t take further steps without guidance.
